1.0 Use of Site
This website (site) is operated by Graham + Sibbald. The head office for Graham + Sibbald is in Dundee, Scotland.
Graham + Sibbald authorises you to view and download the materials on this website. You may not modify the materials on this site in any way. Any use of these materials on any other website for any purpose is prohibited, without prior written permission from Graham + Sibbald. Only complete files may be shared or displayed, and no excerpts or partial files may be made available for distribution.
The materials on this site are copyrighted and any unauthorised use of any materials at this site may violate copyright, trademark, and other laws. If you breach any of these Terms, your authorisation to use this site automatically terminates and you must immediately destroy any downloaded or printed materials. These terms and conditions may, from time to time, be updated to reflect changes to the site and Graham + Sibbald will endeavour to inform you of any changes. However, Graham + Sibbald do not guarantee this and it remains your responsibility to check these terms and conditions regularly.
Graham + Sibbald authorises you to instruct a HomeReport or a HomeReport Refresh for a pre-existing Graham + Sibbald HomeReport. Abuse of this facility will result in the de-activation of your account and the withdrawal of your right to use this site.
Your use of this site indicates that you accept these Terms and Conditions in full.
2.0 Disclaimers
Graham + Sibbald obligations with respect to its services are governed solely by the agreements under which they are provided and nothing on this site should be construed to alter such agreements. Graham + Sibbald may make changes to the materials and services on this site at any time without notice. The materials and services on this site may be out of date, and Graham + Sibbald make no commitment to update the materials and services on this site. Graham + Sibbald scan files for viruses before uploading but do not guarantee that they will be virus free. As such Graham + Sibbald takes absolutely no responsibility for any and all damage or loss incurred through the use of this site, or the downloading of any files.
3.0 Copyright
Except where expressly indicated otherwise, copyright of all of the contents of the website belong to Graham + Sibbald. Notwithstanding the foregoing, Graham + Sibbald hereby authorises you as a User to:
a) View and display the contents of the site.
b) Download the contents and store them in your computer (for example in the browser's cache), for your own personal use.
c) Print out the contents of any downloaded file.
You may not otherwise modify any of the materials or content on the Graham + Sibbald site without written permission from Graham + Sibbald.

You may not use the HomeReport website for the following:
- disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material
- transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or codes of practice
- gaining unauthorised access to other computer systems
- interfering with any other person's use or enjoyment of the site
- interfering with or disrupting networks or web sites connected to the Graham + Sibbald site
Graham + Sibbald reserve the right to:
a) Refuse to post material on the HomeReport site.
b) Remove material already posted on the site without notice.
c) Refuse to accept an instruction to survey.
5.0 Availability of the Site
Although Graham + Sibbald aim to offer you the best online service possible, we cannot promise that the service will meet your requirements. Graham + Sibbald cannot guarantee a fault free service. If a fault does occur in the service you should report it to us by email (homereport@g-s.co.uk)
Your access to http://homereport.g-s.co.uk may occasionally be restricted to allow for repairs, maintenance or the introduction of new facilities or services. Graham + Sibbald will always attempt to restore the service as soon as possible.
The HomeReport site is designed for broadband usage and dialup users may experience longer load times and slower downloads. We have endeavoured to keep file sizes to a minimum, and provide both full pack and single file downloads for each of the HomeReport sections.
6.0 Trade Marks
The names and logos identifying the website and Graham + Sibbald and its products and services are either (a) proprietary marks of Graham + Sibbald or (b) marks which Graham + Sibbald is licensed to use. Nothing in these Terms and Conditions shall confer on the user any license of any proprietary or licensed mark, or of any other intellectual property right of Graham + Sibbald (subject to the above provisions relating to copyright).
7.0 Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Scotland. Any disputes arising here from, shall be exclusively subject to the jurisdiction of the courts of Scotland.
8.0 Non-Acceptance of the Terms and Conditions
If you do not accept these terms and conditions in full, you do not have permission to access the contents of the website and therefore should cease using the website immediately.
9.0 Linking to this Site
You may create links to this site from other sites, but only with the express permission of an authorised signatory of Graham + Sibbald. Please contact homereport@g-s.co.uk for details. It is not possible to directly link to documents on this site and any attempt to do so is strictly prohibited and will breach these conditions which may result in deactivation of your account. This would also represent an attempt to circumvent the security procedures in place on the site, which could have legal implications under telecommunication laws.
10.0 Data protection
Graham + Sibbald are totally committed to protecting your privacy. Except with prior approval by you, any information gathered on this website is used solely for the provision of services by Graham + Sibbald. We protect the privacy of this information by using highly secure password protected servers.
By using this site, you agree to receive emails from us of a non-marketing nature, solely relating to the provision of services on this site. Although Graham + Sibbald will endeavour to notify you of any changes or additions to any files, it is the responsibility of the user to view property files regularly to check this.
If the user has opted to receive marketing materials, the information will be held solely by Graham + Sibbald and will not be passed on to any third party company under any circumstances, without prior written permission from the user.
If the user has accepted the option to display their name to sellers and seller's agents, Graham + Sibbald no longer take any liability from the use of this information by any third party individual or agency involved in the marketing of any property's HomeReport which is downloaded by the user.
The safety and confidentiality of log-in details (username and password), and any activity occurring whilst logged in is the responsibility of individual users. All necessary steps to keep this information secure should be taken, and if you suspect that your log-in details have been made known to any other person, it is your responsibility to change your password and contact us if necessary.
11.0 Reliance on information provided
The Single Survey and Mortgage Valuation Report (if applicable) are carried out by Graham + Sibbald, but any other items available for download from the site are provided by third parties and as such Graham + Sibbald disclaims all liability and responsibility arising from any reliance placed on such materials by any user, or by anyone who may be informed of any of its contents. The provision of these files is for informational purposes only and the hosting of such files does not constitute an endorsement of their validity in any way by Graham + Sibbald.
Although the EPC may not have been carried out by Graham + Sibbald, it is necessary for us to provide one with each HomeReport. As such, it is the duty of the downloader to check who carried out the EPC and Graham + Sibbald take no responsibility for the information provided therein.
12.0 Fees
Graham + Sibbald authorises you to instruct surveys to Graham + Sibbald. These survey instructions will be allocated to a Graham + Sibbald office on the basis of postcode. Should the property to be inspected be located in an area not covered by Graham + Sibbald offices the instruction will be declined. Graham + Sibbald survey reports will be added to this website. The fee indicated on the instruction is calculated on the basis of the estimated value of the property supplied by you. Graham + Sibbald reserve the right to amend the fee quoted either down or up should the property value provided by you prove to be inaccurate. An invoice will be sent to the customer along with a confirmation letter which sets out our survey terms and conditions. The full version of the report will be released as soon as the fee has been paid in full and the draft report has been accepted.
13.0 Delayed Surveys/Reports
Occasionally the surveyor has difficulty in gaining access to the property and is unable to make an appointment to carry out the inspection. It is therefore imperative that you give the correct access details when you are instructing the survey/report. It is the responsibility of the instructing party to provide accurate information and Graham + Sibbald cannot be held liable for any delays caused by inaccurate access details.
14.0 Cancelled Surveys/Reports
Should you wish to cancel the instruction you may do so up to the time of the inspection. Once the inspection has been carried out monies paid by you cannot be returned.
